General Terms and Conditions

1. Introduction

These General Terms and Conditions (hereinafter referred to as “GTC”) govern the rights and obligations of users of the advertising portal NOŽIARI operated by Daniel Melichárek REVIGAS, Company ID: 40769321, registered office Prešovská 40/C, Bratislava, email: info@noziari.sk, URL: https://noziari.sk/ (hereinafter referred to as the “Operator”).

The Portal serves as an online advertising platform where manufacturers (hereinafter referred to as “Sellers”) can add their products free of charge and customers (hereinafter referred to as “Buyers”) can order these products.

The Operator is not a seller or buyer in individual transactions and only acts as an intermediary between the Seller and the Buyer.

2. Definitions

• Seller – a registered user who adds products to the Portal and offers them to Buyers.
• Buyer – a user who orders products on the Portal.
• Order – a binding expression of intent by the Buyer to purchase a product from the Seller via the Portal.
• Purchase Agreement – the contractual relationship between the Seller and the Buyer that arises upon confirmation of the order.
• Portal – the website and application NOŽIARI available at https://noziari.sk/.

3. Registration and Use of the Portal

• Registration on the Portal is a condition for adding products by Sellers and placing orders by Buyers.
• Registration is free of charge. Sellers can add products free of charge.
• Users must provide true and up-to-date information. If false information is detected, the Operator may block or terminate the account.

4. Rights and Obligations of the Seller

• The Seller is responsible for the accuracy, truthfulness and legality of all information provided in the product listing.
• The Seller is responsible for the quality, safety and compliance of the goods with the description and applicable legal regulations.
• The Seller is obliged to process the order within the agreed time and send the goods to the Buyer.
• The Seller is obliged to handle complaints and returns in accordance with applicable legislation and agreed terms.
• The Seller may not post illegal, misleading, offensive content or content that violates the rights of third parties.

5. Rights and Obligations of the Buyer

• The Buyer is obliged to pay the price for the ordered goods in the agreed amount and within the agreed deadline.
• The Buyer is obliged to accept the ordered goods from the Seller according to the agreed delivery terms.
• The Buyer is obliged to provide true information during registration and when ordering.
• The Buyer must comply with the Seller’s delivery, payment and complaint terms.

6. Order and Conclusion of the Contract

• The Buyer places an order through the Portal.
• The purchase agreement is concluded between the Seller and the Buyer by confirming the order by the Seller.
• The Operator is not responsible for whether the Seller confirms or processes the order.

7. Price and Payment Terms

• The price of the product is stated in the product listing and is set by the Seller.
• Payment is made according to the options listed for the product.
• The Operator does not provide payment services and is not responsible for payment transactions.

8. Delivery of Goods

• Delivery of the goods is provided by the Seller according to the agreed terms.
• The Operator is not responsible for delivery delays or damages during transport.

9. Complaints and Returns

• Complaints and returns are handled by the Seller in accordance with applicable legislation.
• The Operator may temporarily suspend or terminate the Seller’s account in case of rule violations or suspected fraud.

10. Rights and Obligations of the Operator

• The Operator provides the Portal as a platform for advertising and mediation of contact between Sellers and Buyers.
• The Operator is not responsible for the quality, accuracy and legality of products and information provided by Sellers.
• The Operator has the right to:
  • remove or block a product that does not meet quality standards or violates rules,
  • suspend or terminate the contractual relationship with the Seller,
  • delete the user account in case of breach of GTC or law.

11. Withdrawal from the Contract (14 days)

• The Buyer has the right to withdraw from the contract without giving any reason within 14 days from receiving the goods.
• Withdrawal must be notified to the Seller in writing (email or contact form).
• The Buyer is obliged to return the goods to the Seller in original condition, undamaged and with complete packaging.
• The Buyer bears the cost of returning the goods unless otherwise agreed.
• The Seller will refund the paid amount within 14 days from receiving the returned goods.

12. Personal Data Protection (GDPR)

The Operator processes personal data in accordance with GDPR and Act No. 18/2018 Coll. on Personal Data Protection. Detailed information is provided in the Privacy Policy.

13. Cookies

The Portal uses cookies to ensure the functionality of the website, analyze traffic and improve user experience. Details are provided in the Cookies Policy.

14. Final Provisions

These GTC enter into force on the date of publication on the Portal. Legal relations not regulated by these GTC are governed by the applicable laws of the Slovak Republic. In case of disputes, the parties will try to resolve them amicably. If not possible, disputes will be resolved by the competent court according to the Operator’s registered office.
